1. Introduction & Agreement
Welcome to Lusitano. These Terms and Conditions (“Terms”) govern your use of our website and our services. By accessing our website or engaging our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services. “We,” “us,” and “our” refer to Lusitano Home Remodeling. “You” and “your” refer to the client, customer, or website user.
2. Services
Lusitano offers a range of interior remodeling services, which may include, but are not limited to:
- Kitchen Remodeling
- Bathroom Remodeling
- Painting
- Flooring
- Additions
- Framing
- Tile installation
- Wall removals
All services are subject to availability and project assessment. We reserve the right to refuse service for any project we deem outside our scope or capabilities.
3. Estimates, Proposals, and Contracts
- Estimates/Proposals: We will provide an initial estimate based on our assessment of the project. Estimates are valid for a specified period and are subject to change based on the final, detailed scope of work, material selections, and unforeseen site conditions discovered during the project.
- Contracts: A formal Contract detailing the final scope of work, materials, payment schedule, and timelines will be provided. No work will commence until the Contract is signed by both parties and the initial deposit is received. The signed Contract supersedes any previous estimates or verbal discussions.
4. Project Process
- Consultation & Design: Initial discussions to understand your vision, preferences, and project scope.
- Proposal & Contract: Presentation of the detailed plan and costs for your review and approval.
- Access & Scheduling: You agree to provide reasonable access to your property during standard working hours. We will make reasonable efforts to meet scheduled timelines, but delays may occur due to weather, material availability, or unforeseen structural issues.
- Permits & Approvals: While we may assist with obtaining permits, it is ultimately the homeowner's responsibility to ensure all necessary local permits and HOA approvals are secured prior to work commencing, unless otherwise explicitly stated in the Contract.
- Change Orders: Any changes to the agreed-upon scope of work, material substitutions, or design alterations requested by you must be documented in writing as a Change Order. Change orders may affect the final cost and project timeline.
- Completion: A final walkthrough will be conducted upon substantial completion. A "punch list" of minor remaining items may be created, to be completed within a reasonable timeframe.
5. Pricing and Payment
- Payment Schedule: The payment schedule for the project will be detailed in the signed Contract.
- Standard schedule: A standard payment schedule often involves an initial deposit (e.g., 10-30%) due upon signing, progress payments at specific milestones, and a final payment due upon substantial completion.
- Invoices: Invoices will be issued for each payment milestone. Payments are due within the timeframe specified on the invoice.
- Late Payments: Late payments may be subject to a late fee as outlined in the Contract. We reserve the right to suspend work if payments are significantly overdue.
- Taxes and Additional Costs: You are responsible for all applicable local and state taxes. Any unexpected costs arising from hidden damages (e.g., rot, mold, outdated wiring) discovered during construction are not included in the initial estimate/contract and will be addressed via a Change Order.
6. Your Responsibilities
- Access: Provide clear and safe access to the work area during agreed-upon working hours.
- Preparation: Remove personal belongings, furniture, and valuables from the work area prior to project start.
- Utilities: Provide access to necessary utilities (water, electricity, restrooms) required for the work.
- Pets & Minors: Ensure pets and minors are kept away from the active work zone for their safety.
- Communication: Communicate any concerns or questions promptly to the designated project manager or contractor lead.
- HOA/Approvals: Obtain necessary approvals from your Homeowners Association (HOA) or local zoning boards prior to commencement.
7. Warranty
- Lusitano warrants that all labor and workmanship will be free from defects for a period of [Specify Duration, e.g., One (1) Year] from the date of substantial completion, unless otherwise noted in the contract.
- This warranty covers issues directly related to the installation or construction performed by our team or our subcontractors.
- This warranty does not cover:
- Materials, appliances, or fixtures. These are covered by their respective manufacturer's warranties, which we will provide to you upon request or at project completion.
- Damage caused by normal wear and tear, abuse, neglect, lack of maintenance, improper use, or Acts of God.
- Defects arising from materials supplied by you or structural issues present prior to our work.
- Work performed or modified by you or any third party after our completion.
- Warranty claims must be submitted in writing. We reserve the right to inspect the issue and determine the appropriate course of action (repair, replacement, or refund) at our discretion.
8. Insurance and Liability
- Lusitano Home Remodeling maintains comprehensive General Liability Insurance and Workers' Compensation Insurance as required by law. Proof of insurance can be provided upon request.
- Limitation of Liability: To the fullest extent permitted by law, our liability for any claims, damages, losses, or expenses arising out of or related to our services shall be limited to the total amount paid by you under the Contract. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of profits, or loss of data, regardless of the cause of action, whether in contract, tort, warranty, or negligence.
9. Subcontractors
We may utilize qualified subcontractors to perform specialized portions of the work (e.g., electrical, plumbing). We remain responsible for the overall project management and the quality of work performed by our subcontractors within the scope of our contract.
10. Website Use (If Applicable)
- Our website is for informational purposes only.
- All content on the website (text, images, logos) is the property of Lusitano or its licensors and is protected by copyright. You may not copy or distribute it without permission. Portfolio images may display completed projects, and similar results cannot be guaranteed for every project.
11. Termination
Either party may terminate the contract under specific conditions outlined in the formal Contract. Termination terms will dictate the handling of completed work, materials purchased, and refunds or remaining payments due.
12. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes applicable to website use will be posted on this page. Any changes related to ongoing or future projects will be communicated to you directly and incorporated into relevant Contracts.
13. Governing Law
These Terms and any contracts entered into with us shall be governed by and construed in accordance with the laws of the State/Province of Fl. Any disputes shall be resolved in the courts located in Tampa.
